Terms of Service

These Terms of Service ("Terms") govern your use of the LocalScribe application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

LocalScribe is an iOS application that transcribes voice recordings and imported audio or video files into text. Transcription runs on your device using Apple's on-device speech engine (for live captions) and the open-source OpenAI Whisper model (for high-accuracy transcripts). Features include in-app recording with live captions, audio and video file import, inline transcript editing, tap-to-jump audio playback, full-library search, and multiple export formats.

2. Important Limitations

LocalScribe is a transcription tool, not a guaranteed verbatim record. You understand and agree that:

• Transcription accuracy depends on audio quality, microphone, background noise, accent, language, and the Whisper model selected. No automated transcription tool is perfect, and important decisions should not rely on an unedited transcript.
• Live captions use Apple's on-device speech engine and may be less accurate than the Whisper pass run after recording.
• Specialized vocabulary (medical terms, legal jargon, proper names, brand names) may be transcribed incorrectly. Always review transcripts intended for legal, medical, or publication use.
• Speaker labels are not provided in v1.0. A single speaker is assumed across the transcript.
• Language auto-detection works on most major languages but may misidentify short or mixed-language recordings — set the language explicitly for best results.

3. Acceptable Use

You agree to use the App only for lawful purposes and only on audio you have the right to process. You agree not to:

• Record or transcribe other people without their knowledge or consent where required by law — recording-consent rules vary by jurisdiction and you are responsible for compliance
• Use the App to transcribe content you do not have rights to (copyrighted broadcasts, confidential material, etc.)
• Reverse engineer, decompile, or extract the bundled or downloaded machine-learning models
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. 30 transcription minutes per month, Whisper Base and Small models, live captions in 100+ languages, TXT export, with banner and interstitial advertising.
• Premium Monthly: $7.99/month. Unlimited transcription minutes, Whisper Large V3 Turbo, all export formats (SRT, VTT, PDF, Markdown, DOCX), background transcription, AI Summary, and zero ads.
• Premium Annual: $39.99/year (save 58% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Recordings, transcripts, library data, and downloaded models are stored locally on your device. You retain all rights to your audio, video, and transcripts. We do not access, collect, or store your content on any server. If you enable optional iCloud sync, your data is stored in your own iCloud account under Apple's terms.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

The App uses the open-source OpenAI Whisper model under the MIT License (see in-app About » Licenses for full attribution) and Apple's Speech framework under Apple's developer agreement. WhisperKit is used under the MIT License (Argmax, Inc).

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT TRANSCRIPTION RESULTS WILL MEET YOUR EXPECTATIONS FOR A SPECIFIC RECORDING, LANGUAGE, OR ACCENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Decisions made based on an automated transcript (legal, medical, journalistic, or business)
• Inaccurate transcription of specialized vocabulary, proper names, or accented speech
• Loss of original recordings or transcripts due to user error or device failure
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any audio you record, transcribe, or distribute.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
